Welcome to Cuniculture Club! The terms “we”, “us” and “our” refer to Cuniculture Club. Cuniculture Club operates this store and website, including all related information, content, features, tools, products and services (the “Services”). Cuniculture Club is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”) together with any policies referenced here describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree, do not use the Services.
SECTION 1 – ACCESS AND ACCOUNT
By using the Services, you represent that you are at least the age of majority in your jurisdiction and that the information you provide (e.g., email, billing and shipping details) is accurate and complete. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
SECTION 2 – OUR PRODUCTS
We work to display product details accurately; however, colors/appearance can vary by device and garment dye lots. Product descriptions, pricing, and availability may change without notice. We may limit quantities or discontinue products at any time.
SECTION 2A – MADE-TO-ORDER & COLOR VARIATIONS
Most items are **made to order in the U.S.** by our print/fulfillment partners. Minor variations in color/placement may occur due to screen settings, garment dye lots, and print method. Please review size charts carefully before purchase. **General returns/exchanges are not accepted** for made-to-order items; see our **Refund Policy** [LINK] for defect/misprint resolutions.
SECTION 3 – ORDERS
When you place an order, you make an offer to purchase. We may accept or decline any order at our discretion; your order is accepted when we confirm and process payment. Please review your order carefully—cancellations may not be possible after acceptance. Purchases are subject to our **Refund Policy** [LINK]. You represent that purchases are for personal or household use and not for resale.
SECTION 3A – ORDER CHANGES & CANCELLATIONS
We’ll try to honor changes/cancellations within **2 hours** of purchase **if production hasn’t begun**. Email **CunicultureClub@outlook.com** with subject “Update Order #[order number].”
SECTION 3B – RESALE & QUANTITY LIMITS
We may limit or cancel orders we believe are placed by dealers, resellers, or distributors.
SECTION 4 – PRICES AND BILLING
Prices, discounts, and promotions may change without notice. The price charged is the price in effect at the time of order. Unless stated otherwise, posted prices exclude taxes, shipping, handling, and any customs/import charges. You agree to provide current, complete, and accurate payment information and authorize us (and our payment processors) to charge your payment method for all amounts due, including applicable taxes and shipping.
SECTION 5 – SHIPPING AND DELIVERY
Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control. Title and risk of loss pass to you when products are tendered to the carrier.
5.1 Address Issues. Orders ship to the address you provide. If a package returns as undeliverable or due to an incorrect address, we can reship to a corrected address; **additional postage may apply**.
5.2 Delivered but Not Received. If tracking shows “delivered,” please check with the carrier and neighbors first. Replacements for suspected theft are handled **case-by-case**.
5.3 Multiple Shipments. To speed delivery, items in the same order may ship separately.
5.4 International Duties/Taxes. For international orders, **duties, VAT, and import fees** are the customer’s responsibility and may be collected by your local carrier.
SECTION 6 – INTELLECTUAL PROPERTY
All content on the Services (designs, logos, text, graphics, images, video, audio, and the selection/arrangement thereof) is owned by or licensed to us and protected by intellectual-property laws. You may use the Services for personal, non-commercial use only. Except as expressly permitted, you may not reproduce, distribute, modify, create derivative works, or publicly display any content without our prior written consent. All trademarks are the property of their respective owners.
SECTION 7 – OPTIONAL TOOLS
We may provide access to third-party tools on an “as-is” and “as-available” basis without warranties. Your use is at your own risk and subject to the third party’s terms.
SECTION 8 – THIRD-PARTY LINKS
The Services may link to third-party sites or include third-party materials. We are not responsible for such sites/materials and you access them at your own risk. Review third-party terms and policies before engaging in any transaction.
SECTION 9 – RELATIONSHIP WITH SHOPIFY

Shopify is not responsible for your purchases or any injury, damage, or loss resulting from purchased products or services. You expressly release Shopify and its affiliates from claims arising out of your purchases and transactions with Cuniculture Club.
SECTION 10 – PRIVACY POLICY

If you submit reviews, photos, ideas, or other content (“Feedback”), you grant us a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display such content in any media for any purpose (including operation, improvement, and promotion of the Services). Do not submit unlawful, harmful, infringing, or misleading content. You represent you own/hold rights to your Feedback.

Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions (e.g., product descriptions, pricing, promotions, shipping charges, transit times, availability). We reserve the right to correct errors, change or update information, or cancel orders if any information is inaccurate at any time without prior notice (including after you submit an order).

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to: violate laws; infringe IP rights; harass, defame, or harm others; transmit malware; scrape or spam; misrepresent your identity; or interfere with the security or operation of the Services. We may terminate or suspend the Services (or your access) at any time in our sole discretion. You remain liable for amounts due up to the termination date. Provisions that by their nature should survive termination will survive (e.g., IP, Feedback, Disclaimers, Liability Limits, Indemnity, Governing Law).

EXCEPT AS EXPRESSLY STATED BY CUNICULTURE CLUB, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; THOSE DISCLAIMERS MAY NOT APPLY TO YOU.
SECTION 16 – LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, CUNICULTURE CLUB, SHOPIFY, AND THEIR RESPECTIVE AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, OR REPLACEMENT COSTS; OR OTHER SIMILAR DAMAGES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY.
**Liability Cap.** To the maximum extent permitted by law, our total liability for any claim related to the Services or products will not exceed the **amount you paid to us for the product(s) giving rise to the claim in the six (6) months** before the event.
SECTION 17 – INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Cuniculture Club, Shopify, and their affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the Services. We will notify you of any indemnifiable claim and may control the defense and settlement at our expense.

If any provision of these Terms is unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted and the unenforceable portion will be deemed severed; the remainder will remain in full force.

Our failure to enforce a provision is not a waiver of that provision. These Terms and the policies posted on the site constitute the entire agreement between you and us regarding the Services and supersede prior agreements.
